The New Brunswick court of appeal ruled on May 21, 2009 that Dr. Henry Morgentaler can proceed with his law suit against the province for refusing to provide financial compensation for abortions performed in his clinic.

Dr. Morgentaler launched his lawsuit against the government because he argues they are obligated under the Canada Health Act to pay for abortions provided in his clinic. Currently women must pay for the procedures out of pocket.

The province had argued that Morgentaler couldn’t sue the province on the issue – that it would have to be a woman who is affected. When a judge initially ruled in his favour, the province took it to the provincial court of appeal.

This weeks ruling grants him standing to proceed with his lawsuit on behalf of the women who seek the abortions in his clinic.
